Agreement

These Terms of Service (“Terms”) apply when you visit jesslindesigns.com, download or use the Clocked app, or use any tool or integration provided by Jess Lin Designs LLC (“Jess Lin Designs,” “we,” “us,” “our”), a California limited liability company based in Cardiff-by-the-Sea, California, USA (together, the “Services”). By using the Services you agree to these Terms. If you do not agree, please do not use them.

Our Privacy Policy explains how we handle personal information and is part of these Terms.

Who can use the Services

You must be at least 16 years old, or the age of digital consent where you live if higher, to use the Services. If you use the Services on behalf of a company or organization, you confirm you are authorized to accept these Terms for it.

Using the site

You may browse the site and share links to it for personal or business purposes. You agree not to:

• copy, resell or republish the site’s design, code, text or images, except for sharing links or short quotes with credit;
• interfere with the site’s security or operation, or try to access areas not meant for the public (such as /api/ or /downloads/) other than through the site’s own forms;
• use the Services to break any law or to infringe anyone’s rights;
• submit false information or someone else’s email address in our forms.

Search engines and AI assistants may read and index the public pages of this site as allowed by our robots.txt file.

Our work and intellectual property

The site, its design, code, text, graphics, the Jess Lin Designs name and the JL mark belong to Jess Lin Designs LLC and are protected by copyright and trademark law. Client work shown in the portfolio is displayed with permission or under the terms of our agreements with those clients. Client names, logos and trademarks belong to their owners, and showing them does not mean they endorse these Terms or the site.

Nothing on the site grants you a license to use our work or a client’s work beyond viewing it here.

Design services

Information about our services, process, availability and booking dates is general and may change. It is not an offer or a contract. Every client project is governed by its own written proposal, statement of work or agreement, which controls if it conflicts with these Terms.

Testimonials on the site reflect individual clients’ experiences and are shared with their permission.

The Clocked app

Clocked is a free macOS time tracker made by Jess Lin Designs. When you download it, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use it on Macs you own or control, for personal or business use. You may not sell, rent, or redistribute Clocked, or remove its notices.

Clocked runs on your Mac and stores its data locally. You are responsible for your own backups and for how you use the time records it creates, including any you share with clients. Clocked is provided “as is,” without support obligations, and we may update or discontinue it at any time.

To download Clocked you agree to receive emails about it. You can unsubscribe at any time using the link in any email.

Connected accounts and third-party platforms

Some of our tools let you connect an account on a third-party platform, such as TikTok or Instagram, for example to publish content or view basic account information. When you connect an account:

• you authorize us to access only the information and permissions shown on that platform’s authorization screen, and only to provide the feature you chose;
• you remain responsible for the content you publish and must follow that platform’s own terms and community guidelines, including TikTok’s Terms of Service;
• you can disconnect at any time from the tool or from your account settings on that platform, and you can ask us to delete related data as described in our Privacy Policy.

Third-party platforms are not operated by us, and we are not responsible for their availability, changes or practices. Our tools are not endorsed by or affiliated with those platforms unless we say so.

Links to other sites

The site links to other websites, including client sites and social profiles. We do not control them and are not responsible for their content or practices.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not promise that the Services will be uninterrupted, error-free or secure, or that Clocked will be accurate for every use.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, JESS LIN DESIGNS LLC AND ITS OWNER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO ONE HUNDRED US DOLLARS (US$100). This section does not apply to client projects, which are governed by their own agreements, or limit any liability that cannot be limited by law.

Indemnity

You agree to defend and indemnify Jess Lin Designs LLC against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Services, the content you publish through a connected account, or your breach of these Terms.

Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in San Diego County, California, and you and we consent to their jurisdiction. If you are a consumer in a country that gives you the right to bring claims in your local courts, nothing here removes that right.

General

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business transfer. These Terms, our Privacy Policy and any written agreement for a project are the entire agreement between you and us about the Services.

Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. If you keep using the Services after an update, you accept the new Terms.
